Terms of Use

Ekalavya Careers

Effective Date: Aug 26, 2026
Website: swatwam.com

These terms cover two products: our careers assessments and coaching for individuals, and the Swatwam schools platform. School staff should read Parts A, C and E. Parents and students at a school should read Parts A, D and E.

Part A

General

1. Acceptance of Terms

By accessing, browsing, or using the website, assessments, schools platform, or programs offered by Ekalavya Careers (“we”, “our”, “us”), you agree to be bound by these Terms of Use.

If you are under 18 years of age, you may use our services only with the involvement and consent of a parent or legal guardian.

Where a school has signed a separate written agreement with us, that agreement governs the commercial relationship and these Terms govern everyone’s use of the platform. If the two conflict on a commercial point, the school’s agreement prevails.

If you do not agree to these Terms, please do not use our services.

2. About Our Services

Ekalavya Careers provides:

  • Career discovery and coaching programs
  • Psychometric and behavioral assessments
  • Mentorship and personal development services
  • Educational content, tools, and resources
  • The Swatwam schools platform — an observation ledger, Holistic Development Profiles, portfolios, curriculum and lesson planning tools, timetables, homework and notices, and assessments for a school’s students, teachers and parents

Our services are designed to support self-awareness, clarity, and long-term growth.

3. Eligibility and Accounts

  • You must provide accurate and complete information
  • You must not use the platform for unlawful purposes
  • Minors require verified parental or guardian consent
  • You are responsible for keeping your password confidential and for everything done under your account. Accounts are personal and must not be shared — a shared login makes the record of who observed what untrue
  • Tell us or your school immediately if you believe an account has been compromised

We reserve the right to refuse or revoke access if these conditions are not met.

Part C

Schools

7. The School’s Role and Responsibilities

A school using the platform is the controller of its own data. We process it on the school’s instructions, as set out in our Privacy Policy. The school is responsible for:

  • Obtaining the consent of parents and lawful guardians before children’s data is entered, and keeping a record of it
  • The accuracy of its roster, and keeping it current as children and staff join and leave
  • Deciding which staff hold which role, and reviewing those assignments — a role decides what a person can see
  • Removing access promptly for anyone who leaves the school
  • Training its staff on what belongs in an observation and what does not
  • Choosing which features to enable and which year groups take an assessment

A school must not enter data about a child who is not enrolled with it, or use the platform to hold records unrelated to a child’s education and development.

8. Features, Entitlements and Rollout

  • Features are enabled per school. A school has access only to what it has bought
  • Assessments have a second control: the school decides which grades are switched on for students, teachers and parents. Until a grade is switched on, nobody in it is enrolled
  • Students are offered an assessment only from Grade 10 upward. This floor is enforced by us and cannot be lowered by a school
  • We may add, change or withdraw features. Where a change removes something a school is paying for, we will give reasonable notice

9. AI Usage and Billing

  • Several features cost money each time they are used — profile generation, weekly plans, lesson plans, curriculum guides, voice transcription and assessments
  • Every such call is metered against the school and shown to the school in its usage view. A principal can see the running total and the breakdown by feature
  • Rates are applied at the time of the call. A later change to our rate card does not reprice a month that has already been invoiced
  • A retried generation is still a call the provider charged for, and is metered
  • A school is responsible for metered usage incurred under its accounts, including by its own staff

We may apply fair-use limits, or pause a metered feature, where usage is materially beyond what was agreed. We will tell the school before doing so wherever practical.

10. Storage

  • Each school has a photograph and attachment storage allowance, and can see what it is using
  • Uploads are refused once the allowance is exhausted. Additional storage can be purchased
  • Individual uploads are subject to a size limit and are re-encoded on our servers
  • A school must not use the platform as general file storage, or upload material unrelated to a child’s education and development

11. Observations: The Record and the Audit Trail

An observation is a record about a real child that a family may eventually read. It is written to be kept.

  • Record what you saw and its context — not a judgement of the child’s character, family or circumstances
  • Do not record medical, disciplinary or safeguarding matters here. Those belong in the school’s own processes, which this platform is not
  • Do not name other children in an observation about one child
  • You may edit or delete your own observation until a profile has been built from it. After that it is fixed, because it has already shaped what was written about the child
  • An edit keeps the previous version and is stamped. The ledger is an audit trail; it is not a draft
  • You may only see and act on observations you wrote yourself, unless your role gives you a wider view

Attempting to see, alter or export records outside your role — or to work around the access controls — is a breach of these Terms and may be a breach of law.

12. Holistic Development Profiles

  • A profile is generated from the observations recorded, and is rewritten as new observations arrive
  • Development levels, trends and confidence are computed from the evidence. The AI writes the narrative; it does not choose the rating
  • A generated profile is not visible to a family until a person at the school releases it. Generation always retracts a previous release, so an updated profile is reviewed again
  • Where a school has enabled observer approval, only its nominated observer — plus our staff supporting them — may release. A parent can never release a profile
  • Whoever releases a profile is responsible for having read it
  • A teacher may record their own reading of a level, and a reviewer may rewrite the summary a parent reads. Both sit beside the generated text rather than replacing it

13. Voice Observations and Photographs

  • A spoken observation is transcribed and the audio is discarded. The teacher must read and correct the transcript before saving it — transcription mishears names
  • Photographs may only be taken and uploaded where the school has obtained consent for it, and only of the child the record concerns
  • A photograph is part of a child’s record. It must not be downloaded, forwarded or re-shared outside the platform, and must never be posted publicly or on social media
  • We apply no facial recognition or biometric processing to any image, and nobody may attempt to use the platform for that purpose

14. Assessments in Schools

  • A report is withheld until a coach has reviewed and approved it. This is a quality gate, not a formality
  • A principal may not approve their own school’s reports. Only the school’s nominated coach and our own staff may
  • A teacher’s or parent’s own assessment result belongs to them. A school must not use it as a performance appraisal, a hiring or retention criterion, or a judgement of a parent
  • A student’s assessment must not be used to stream, exclude or refuse a child a subject

15. Pilot Schools

  • Pilot schools sign in with an email address and password issued by us rather than through our standard sign-in provider
  • Demonstration accounts are for demonstration. They must not be used to hold real records about real children
  • Pilot features may change or be withdrawn during the pilot, and are provided without a service level commitment

Part D

Parents and students

16. What a Parent Can See and Do

As a parent or guardian with an account, you can:

  • See your own children, and no other child
  • Read your child’s Holistic Development Profile once the school has released it, written in plain words for you
  • Record your own observations of your child at home, which contribute to the picture
  • See the observations you wrote. You do not see a teacher’s notes, and no other parent sees yours
  • Read homework and notices addressed to your child’s class
  • Correct your child’s own roster details
  • Take the parent assessment, where your school has offered it. The result is yours

Your account is linked to your child by the school. If a child you expect is missing, contact the school office — we cannot link a child to you without the school.

17. What the Profile Is — and What It Is Not

A Holistic Development Profile describes what adults have noticed about how your child learns and relates, across five areas. It is written to start a conversation.

It is not:

  • A diagnosis. It is not a medical, psychological, psychiatric or clinical assessment, and must never be used as one. If you have a concern about your child’s health or development, speak to a qualified professional
  • An assessment of special educational needs, or a substitute for one
  • A grade, a rank, or a score against other children
  • A prediction of what your child will become
  • A basis on its own for a decision about schooling, streaming, admission or a career

Development levels describe growth over time, not achievement. A child at “emerging” in an area is not behind; they are at the start of something that has been noticed. Confidence figures tell you how much was observed, and a profile built on little evidence says so.

Exam marks are shown as marks. They are deliberately never converted into a development level.

18. Parent and Guardian Responsibilities

Parents or guardians agree to:

  • Provide informed consent, through the school
  • Record observations honestly, and about your own child only
  • Treat what you read as confidential to your family. Do not share, screenshot, forward or post your child’s profile, photographs or any part of the platform publicly or in parent groups
  • Never use anything you see about another child, if you encounter it in error, and tell the school straight away
  • Avoid coercion or forcing career decisions
  • Support the child’s exploration and development
  • Raise disagreements about what a teacher recorded with the school rather than with the child
  • Respect the coaching process

Schools do not charge parents through this platform. Where a school has bought the platform, there is nothing for a parent to pay us.

19. Student Accounts

  • A student account is created only where the school records the student’s own email address, and only for older students
  • A student sees their own record, and no other child’s
  • A student under 18 uses the platform with the consent of their parent or guardian
  • A student’s account is theirs. It must not be operated by a parent or a teacher on their behalf

Part E

Common to everyone

20. User Responsibilities and Code of Conduct

By using our services, you agree to:

  • Provide truthful and accurate responses
  • Maintain confidentiality of your login credentials
  • Use the platform respectfully
  • Not attempt to manipulate or misuse assessments

You agree not to:

  • Engage in abusive, offensive, or harmful behaviour
  • Disrupt sessions or platform functionality
  • Misuse content or services
  • Attempt to access data outside your role, probe or circumvent access controls, or scrape or bulk-export records
  • Upload malware, or content that is unlawful, defamatory or harmful to a child

Violation may result in suspension or termination of access.

21. Intellectual Property

All materials, including:

  • Assessments
  • Reports and profile templates
  • Frameworks, including the development areas and levels
  • Program content, lesson plans and curriculum guides

are owned by Ekalavya Careers.

You may not:

  • Copy, reproduce, distribute, or resell content
  • Reverse-engineer or replicate assessments

A school’s own records — its roster, its staff’s observations, its marks, its portfolios and its photographs — remain the school’s. A school may use the material generated for it, including lesson plans and profiles, for the education of its own students. It may not resell it or supply it to another institution.

22. Confidentiality

We maintain the confidentiality of:

  • Personal information
  • Assessment data
  • Observations, profiles and photographs of children

Information may be shared:

  • With parental consent, for minors
  • With coaches and mentors for service delivery
  • With the school’s own staff, according to the role the school assigned them
  • With our staff supporting, reviewing or billing the school
  • If required by law

23. Data Privacy

Your use of our services is governed by our Privacy Policy, which explains what we hold about children, who can see it, where AI is used, and how to exercise your rights.

We are committed to protecting your data. We do not sell personal data, and we do not use children’s data for advertising or to train models.

24. Availability and AI Output

  • The platform is provided on a reasonable-efforts basis. We do not guarantee uninterrupted availability, and we may take it down for maintenance
  • AI-generated text can be wrong, incomplete, or miss context an adult in the room would have. It is a draft for a person to check, which is why nothing reaches a family unreviewed
  • Transcription can mishear, particularly names. The teacher is responsible for the text they save
  • Schools should keep their own records of anything they are legally required to retain, rather than relying solely on this platform

25. Limitation of Liability

To the fullest extent permitted by law:

Ekalavya Careers shall not be liable for:

  • Decisions made on the basis of coaching, assessments, profiles or AI-generated content
  • A school’s or a user’s own use of the platform, including what its staff record and who it grants access to
  • Indirect, incidental, or consequential damages
  • Outcomes beyond our control

26. Suspension, Termination and Exit

We reserve the right to:

  • Suspend or terminate access for violations of these Terms
  • Suspend an individual account immediately where we believe a child’s data is at risk
  • Modify or discontinue services at any time

When a school’s agreement ends, we will make its data available for export for a reasonable period and then delete or return it on the school’s instruction, subject to any retention the law requires. Deactivating a person’s account revokes their access without erasing the record of what they contributed.

27. Changes to Terms

We may update these Terms periodically.

Updated Terms will be posted on this page with a revised effective date. Where a change materially affects a school, we will also tell the school directly. Continued use of services constitutes acceptance.

28. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Any disputes shall be subject to the jurisdiction of the courts in Pune, Maharashtra.
